毕业于大学法律专业的意大利刑法学家切萨雷·贝卡里亚（Ｂｅｃｃａｒｉａ，Ｍａｒｃｈｅｓｅ Ｃｅｓａｒｅ Ｂｏｎｅｓａｎａ ｄｅ １７３８—１７９４）以《论犯罪与刑罚》一书名世。１９３６年郑竞毅、彭时所著《法律大辞书》之补篇，介绍贝卡里亚当时翻译的中文译名为“培卡利阿”，云：“意大利之法理学家，兼经济学家，精通法理学及经济学，其识见拔卓一世，后为奥国之高官，鞅掌国务至二十年之久。其间关于谷仓、货币、度量衡制度之报告，十进位法之采用，均有所尽力，彼对于法理学，反对死刑论，详论刑法之改正。”其所著书，“除关于反对死刑，著《犯罪与刑罚》一书外，又有《经济要论》一书，行世。意大利人誉之为意大利刑法学之开山鼻祖。”实则贝卡里亚不仅是意大利刑法学之开山鼻祖，在世界刑法学之历史上也是一重镇。
